Welcome to MobileLaunch (https://mobilelaunch.app/). By accessing or using our platform, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

If you do not agree to these Terms, please do not use MobileLaunch.

1. Description of Service

MobileLaunch is a platform that helps mobile app developers promote their iOS and Android applications and gain visibility through weekly competitions. Users can:
- Submit mobile apps for promotion
- Browse and discover new mobile apps
- Upvote apps they find interesting
- Compete for podium positions with rewards
- Access free and premium features

The basic service is free to use. Premium features are available through one-time purchases.

2. Eligibility

You must be at least 13 years old to use MobileLaunch. By using our platform, you represent and warrant that you meet this age requirement.

If you are using MobileLaunch on behalf of a company or organization, you represent that you have the authority to bind that entity to these Terms.

3. User Accounts

3.1 Account Creation
To access certain features, you must create an account by providing:
- Name
- Email address
- Optional profile information (bio, social links, avatar)

3.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access

3.3 Account Authenticity
You agree to:
- Provide accurate and complete information
- Keep your information up to date
- Not create multiple accounts for abusive purposes
- Not share your account with others

4. App Submissions

4.1 Submission Guidelines
When submitting an app, you must:
- Provide accurate information (name, description, links, screenshots)
- Own the app or have authorization to promote it
- Ensure the app is published or available on official app stores
- Not submit apps containing illegal, harmful, or misleading content
- Not submit apps that violate intellectual property rights

4.2 App Launches and Competitions
- Apps participate in weekly competitions (batches) running Monday to Sunday
- Users can upvote apps they find interesting
- Podium positions (1st, 2nd, 3rd) may receive rewards as specified by app makers
- Competition results are based on quality scores derived from upvotes, engagement metrics, and app quality indicators
- We reserve the right to remove apps that violate these Terms

4.3 Rewards and Incentives
App makers may optionally offer rewards (discount codes, premium access, etc.) to voters who supported their app if it finishes in a podium position (1st, 2nd, or 3rd place):

- Rewards are optional and solely provided by app makers
- App makers must provide valid reward codes before scheduling their launch
- Rewards are locked once a launch goes live and cannot be modified
- All users who voted for a podium-finishing app receive a reward code via email
- Reward codes are distributed automatically when the weekly batch completes
- MobileLaunch is not responsible for the value, validity, or fulfillment of rewards provided by app makers
- App makers are solely responsible for honoring the rewards they offer
- Rewards cannot be exchanged, refunded, or transferred unless specified by the app maker
- MobileLaunch reserves the right to remove apps offering fraudulent or misleading rewards

4.4 Content Ownership
You retain ownership of your app and all submitted content. By submitting content to MobileLaunch, you grant us a worldwide, non-exclusive, royalty-free license to:
- Display your app on our platform
- Use app information for promotional purposes
- Include your app in our marketing materials

5. Upvoting and User Engagement

5.1 Fair Use
Users may upvote apps they genuinely find interesting. You agree not to:
- Create fake accounts to manipulate votes
- Use bots or automated tools to vote
- Coordinate vote manipulation schemes
- Exchange votes or payments for votes

5.2 Enforcement and Fraud Prevention
We take fraud and vote manipulation seriously. We reserve the right to:
- Remove fraudulent upvotes
- Disqualify apps from competitions
- Remove apps that engage in fraudulent activities
- Ban users who violate fair use policies
- Terminate accounts of app owners who engage in fraud

App owners who engage in fraudulent activities (including but not limited to vote manipulation, creating fake accounts, coordinating vote schemes, or offering misleading rewards) may have their account permanently terminated and all their apps removed from the platform.

6. Payments and Refunds

6.1 Premium Features
Some features are available through one-time purchases, including:
- Premium app visibility
- Additional launch opportunities
- Priority support

6.2 Payment Processing
All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's Terms of Service: https://stripe.com/legal

6.3 Refund Policy
- Refunds are available within 7 days of purchase for unused features
- To request a refund, contact us at: contact@mobilelaunch.app
- Refunds are processed to the original payment method within 5-10 business days
- Once a feature is used (e.g., app launched), refunds may not be available

6.4 Pricing Changes
We reserve the right to modify pricing for premium features. Current users will be notified of pricing changes via email.

8. User Conduct

You agree to use MobileLaunch in a lawful and respectful manner. You may NOT:
- Post harmful, misleading, fraudulent, or illegal content
- Violate intellectual property rights of others
- Harass, threaten, or abuse other users
- Attempt to hack, disrupt, or compromise platform security
- Use the platform for spam or unauthorized advertising
- Scrape or collect data without authorization
- Impersonate others or misrepresent your identity
- Engage in vote manipulation or fraud
- Abuse, resell, or redistribute reward codes received from the platform
- Create multiple accounts to receive duplicate reward codes

9. Intellectual Property

9.1 Platform Content
All MobileLaunch branding, logos, design, and original content are owned by MobileLaunch and protected by intellectual property laws. You may not use our intellectual property without written permission.

9.2 User Content
Users retain ownership of their submitted content (apps, descriptions, images). Other users' content is their property and may not be used without permission.

9.3 Third-Party Links
MobileLaunch contains links to third-party app stores and websites. We are not responsible for the content or practices of these third-party sites.

10. Disclaimers and Limitation of Liability

10.1 Service "As Is"
MobileLaunch is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free service

10.2 No Guarantee of Results
We do not guarantee:
- That your app will receive upvotes or win competitions
- Specific rankings or visibility
- Conversions, downloads, or revenue from app promotion
- The validity, value, or fulfillment of rewards offered by app makers
- That reward codes will work or provide the described benefits

10.3 Limitation of Liability
To the maximum extent permitted by law, MobileLaunch shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or business opportunities
- Damages exceeding the amount you paid us in the past 12 months
- Any issues arising from reward codes provided by app makers, including but not limited to invalid codes, expired codes, or unfulfilled rewards
- Disputes between users and app makers regarding rewards

10.4 User Responsibility
You are responsible for:
- Your use of the platform
- Content you submit
- Interactions with other users
- Compliance with app store guidelines

11. Indemnification

You agree to indemnify and hold harmless MobileLaunch, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the platform
- Your submitted content
- Your violation of these Terms
- Your violation of others' rights

12. Termination

12.1 By You
You may delete your account at any time through your account settings or by contacting us at: contact@mobilelaunch.app

12.2 By Us
We reserve the right to suspend or terminate your access to MobileLaunch at any time, with or without notice, for:
- Violating these Terms
- Fraudulent or abusive behavior
- Legal requirements
- Discontinuation of the service

12.3 Effect of Termination
Upon termination:
- Your account access will be revoked
- Personal data will be deleted within 30 days (see Privacy Policy)
- Submitted apps may remain visible on the platform
- Paid features are non-refundable (unless within refund period)

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Effective Date" at the top
- Sending an email notification to registered users

Your continued use of MobileLaunch after changes constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

14.1 Governing Law
These Terms are governed by the laws of France, without regard to its conflict of law provisions.

14.2 Jurisdiction
Any disputes arising from these Terms or your use of MobileLaunch shall be subject to the exclusive jurisdiction of the courts of France.

14.3 Informal Resolution

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and MobileLaunch regarding your use of the platform.
